GENERAL TERMS AND CONDITIONS OF SALE

 

Effective date: January 11, 2025

1 – PURPOSE

These General Terms and Conditions of Sale apply, without restriction or reservation, to all online sales offered by DOG DAYCARE (hereinafter referred to as the “Seller” or “DOG DAYCARE”) on the website http://www.dogdaycare.fr/ (hereinafter referred to as the “Site”).

The Site is an e-commerce platform enabling users (hereinafter referred to as the “Buyers”) to order dog daycare services, dog wash, animal care, venue privatization, and workshops (hereinafter referred to as the “Services”).

These Terms define the conditions of online sales and service delivery, as well as the rights and obligations of the parties.

They are accessible at any time via a direct link at the bottom of the Site.

The applicable version is the one available on the Site at the time of the Buyer’s order. A copy is sent with the order confirmation.

These Terms prevail over any other general or specific conditions not expressly approved by DOG DAYCARE.

They may be supplemented by specific terms applicable to certain Services, which shall prevail in case of contradiction.

DOG DAYCARE’s failure to enforce any provision at a given time shall not be interpreted as a waiver.

The invalidity of any clause shall not affect the validity of the remaining provisions.

The Site is accessible 24/7, except in cases of maintenance, updates, force majeure, or technical issues. DOG DAYCARE shall not be held liable for any unavailability.

DOG DAYCARE does not guarantee that the Site will be free from errors or interruptions.

The Site is operated by DOG DAYCARE, a simplified joint-stock company (SAS) with a share capital of €5,000, registered with the Meaux Trade and Companies Register under number 934 888 124.

3 – LEGAL CAPACITY & ACCEPTANCE

3.1 Legal Capacity

The Site is accessible to:

  • Any individual with full legal capacity

  • Any legal entity represented by a duly authorized individual

3.2 Acceptance

Acceptance is confirmed by ticking a checkbox during the order process.
Acceptance must be full and unconditional.

3.3 Registration

Placing an order requires creating an account.

The Buyer must provide accurate and complete information.
An account (“Personal Account”) is created upon registration.

The Buyer agrees to keep information updated and is solely responsible for account confidentiality.

4 – SERVICES DESCRIPTION

Before placing an order, the Buyer can review the characteristics of each Service.

DOG DAYCARE strives to ensure descriptions and visuals are as accurate as possible.

5 – ORDERS – SPECIFIC TERMS – MODIFICATIONS & CANCELLATION

5.1 Order Process

The Buyer selects Services and validates the order.

5.2 Confirmation

A confirmation email is sent including:

  • Order summary

  • Execution details

  • Applicable Terms

Specific Conditions

Admission Requirements

  • Minimum age: 6 months

  • Mandatory vaccinations (kennel cough recommended)

  • Social behavior required

  • Parasite prevention required

  • No category 1 & 2 dogs

  • No dogs in heat

  • Microchip identification required

  • ICAD registration required

Discovery Session (2h)

Mandatory before regular daycare enrollment.
Owner must remain reachable.

Veterinary Emergencies

DOG DAYCARE may contact a veterinarian if needed.
All costs are borne by the owner.

Exclusion Policy

DOG DAYCARE may exclude a dog in case of:

  • Inappropriate behavior

  • Excessive noise

  • Lack of cleanliness

  • Reactivity

Additional Fees

Late pick-up may incur additional charges.

Modification

Free modification up to 48h before booking (subject to availability).

Cancellation

  • Deposit non-refundable

  • Full charge applies if canceled <48h or no-show

Optional Cancellation Insurance

Koala Flex available (conditions apply).

Early Arrival / Late Departure

  • €25/hour (if booked at least 24h in advance, )

  • €30/hour (if decided on-site, subject to availability)

  • Any hours booked in advance are non-refundable. Each hour started is due in full

  • +€5 per additional dog/hour

6 – PRICING & PAYMENT

6.1 Prices

Prices are in euros, all taxes included. DOG DAYCARE may apply promotional offers.

6.2 Payment

  • Deposit required at booking

  • Balance due 24h before or on-site

Payment methods:

  • Credit card (fees may apply)

  • Bank transfer

DOG DAYCARE may suspend orders in case of non-payment or fraud.

Membership packages are prepaid and non-refundable.

6.3 Invoicing

Invoices are sent by email.

7 – SERVICE DELIVERY

Services are provided exclusively in mainland France.

8 – RIGHT OF WITHDRAWAL

The right of withdrawal applies in accordance with consumer law.

However, services provided on a specific date (such as daycare bookings) are not eligible for withdrawal.

If applicable:

  • Refund within 14 days

  • Payment proportional if service already started

The Buyer must notify DOG DAYCARE before the deadline.

9 – LEGAL WARRANTIES

DOG DAYCARE reminds Buyers that they benefit from the legal warranty of conformity and the warranty against hidden defects, including any lack of conformity.

If the Buyer notices that the Service provided is defective, non-compliant, or damaged, they must inform DOG DAYCARE using the contact details specified in Article 2, describing the issue and providing any relevant evidence, particularly photographs.

DOG DAYCARE will carry out the necessary checks and, where possible, offer a replacement Service. If replacement is not possible, DOG DAYCARE will refund the full amount paid for the Service within a maximum of fourteen (14) days from the date the Buyer is informed of the impossibility of replacement.

Legal provisions relating to warranties are reproduced in Appendix 1.

10 – BUYER’S OBLIGATIONS

Buyers are solely responsible for their choice and use of the Services. It is their responsibility to ensure that the Services meet their specific needs prior to purchase.

They must also take appropriate measures to back up any information stored in their Personal Account.

Buyers are responsible for protecting their own data and software stored on their devices.

11 – LIABILITY OF DOG DAYCARE

DOG DAYCARE undertakes to regularly monitor the proper functioning and accessibility of the Site. It may temporarily suspend access for maintenance purposes.

DOG DAYCARE shall not be held liable for temporary access difficulties due to external circumstances, force majeure, or telecommunications disruptions.

DOG DAYCARE does not guarantee that the Services will meet the Buyer’s specific expectations.

DOG DAYCARE shall not be liable for any damage, direct or indirect, caused by:

  • Negligence or fault of the Buyer or a third party

  • Use of the Services under inappropriate conditions

DOG DAYCARE shall not be held responsible for delays or failure to perform due to force majeure, including but not limited to: extreme weather, natural disasters, fires, floods, cyber incidents, strikes, or regulatory constraints.

In any case, DOG DAYCARE’s liability is strictly limited to proven direct damages suffered by the Buyer.

12 – INTELLECTUAL PROPERTY – IMAGE RIGHTS

All elements of the Site (systems, software, content, visuals, logos, etc.) are protected by intellectual property laws.

Any reproduction, extraction, or use without prior authorization is strictly prohibited and may lead to legal action.

By accepting these Terms, the Owner authorizes DOG DAYCARE to photograph or film their dog during its stay.

These images may be used for communication purposes (website, social media, brochures, etc.), free of charge, for a period of ten (10) years.

The Owner may withdraw consent at any time by written request.

13 – PERSONAL DATA, NEWSLETTER & TELEPHONE SOLICITATION

13.1 Personal Data

DOG DAYCARE applies a personal data protection policy detailed in the “Privacy Policy”.

DOG DAYCARE is committed to protecting personal data in accordance with GDPR regulations.

Personal data is collected for order processing and service delivery.

Data is stored securely and retained only as long as necessary.

Buyers have the right to:

  • Access

  • Rectify

  • Delete

  • Restrict processing

  • Data portability

  • Object to processing

Complaints can be submitted to the CNIL.

13.2 Newsletter

By subscribing, the Buyer agrees to receive newsletters and commercial offers.

Unsubscription is possible at any time via the link included in each email.

13.3 Telephone Opt-Out List

Buyers may register for free on the BLOCTEL list to opt out of telemarketing:

14 – ADVERTISING

DOG DAYCARE reserves the right to display promotional or advertising content on the Site.

15 – THIRD-PARTY LINKS

DOG DAYCARE is not responsible for third-party websites or applications accessible via the Site.

These are governed by their own terms and conditions.

DOG DAYCARE is not liable for transactions between the Buyer and third parties.

16 – PROHIBITED BEHAVIOURS

Strictly prohibited:

  • Disrupting the Site

  • Unauthorized access attempts

  • Misuse of system resources

  • Breach of security measures

  • Any illegal or harmful activity

DOG DAYCARE reserves the right to take legal action if necessary.

17 – ACCOUNT DELETION

The Buyer may delete their account at any time by contacting DOG DAYCARE.

Deletion is effective within 7 days.

18 – MODIFICATIONS

DOG DAYCARE may modify these Terms at any time.

The applicable version is the one in force at the time of the order.

19 – LANGUAGE

In case of translation, the French version shall prevail.

20 – MEDIATION

Consumers may use a mediator free of charge.

21 – APPLICABLE LAW & JURISDICTION

These Terms are governed by French law.

Any dispute shall fall under the jurisdiction of the courts of Paris.

APPENDIX 1 – LEGAL WARRANTY PROVISIONS

Article L. 217-4 du Code de la consommation

Le vendeur est tenu de livrer un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance. Il répond également des défauts de conformité résultant de l’emballage, des instructions de montage ou de l’installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.

Article L. 217-5 du Code de la consommation

Le bien est conforme au contrat :

S’il est propre à l’usage habituellement attendu d’un bien semblable et, le cas échéant :

  • s’il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l’acheteur sous forme d’échantillon ou de modèle ;

  • s’il présente les qualités qu’un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l’étiquetage ; Ou s’il présente les caractéristiques définies d’un commun accord par les parties ou est propre à tout usage spécial recherché par l’acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.

Article L. 217-7 Code de la consommation

Les défauts de conformité qui apparaissent dans un délai de vingt-quatre mois à partir de la délivrance du bien sont présumés exister au moment de la délivrance, sauf preuve contraire. Pour les biens vendus d’occasion, ce délai est fixé à six mois. Le vendeur peut combattre cette présomption si celle-ci n’est pas compatible avec la nature du bien ou le défaut de conformité invoqué.

Article L. 217-8 Code de la consommation

L’acheteur est en droit d’exiger la conformité du bien au contrat. Il ne peut cependant contester la conformité en invoquant un défaut qu’il connaissait ou ne pouvait ignorer lorsqu’il a contracté. Il en va de même lorsque le défaut a son origine dans les matériaux qu’il a lui-même fournis.

Article L. 217-9 Code consommation

En cas de défaut de conformité, l’acheteur choisit entre la réparation et le remplacement du bien. Toutefois, le vendeur peut ne pas procéder selon le choix de l’acheteur si ce choix entraîne un coût manifestement disproportionné au regard de l’autre modalité, compte tenu de la valeur du bien ou de l’importance du défaut. Il est alors tenu de procéder, sauf impossibilité, selon la modalité non choisie par l’acheteur.

Article L. 217-10 Code de la consommation

Si la réparation et le remplacement du bien sont impossibles, l’acheteur peut rendre le bien et se faire restituer le prix ou garder le bien et se faire rendre une partie du prix. La même faculté lui est ouverte :

1° Si la solution demandée, proposée ou convenue en application de l’article L. 217-9 ne peut être mise en œuvre dans le délai d’un mois suivant la réclamation de l’acheteur ;

2° Ou si cette solution ne peut l’être sans inconvénient majeur pour celui-ci compte tenu de la nature du bien et de l’usage qu’il recherche. La résolution de la vente ne peut toutefois être prononcée si le défaut de conformité est mineur. »

Article L.217-11 du Code de la consommation

L’application des dispositions des articles L. 217-9 et L. 217-10 a lieu sans aucun frais pour l’acheteur. Ces mêmes dispositions ne font pas obstacle à l’allocation de dommages et intérêts.

Article L. 217-12 du Code de la consommation

L’action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.

Article L. 217-16 du Code de la consommation

Lorsque l’acheteur demande au vendeur, pendant le cours de la garantie commerciale qui lui a été consentie lors de l’acquisition ou de la réparation d’un bien meuble, une remise en état couverte par la garantie, toute période d’immobilisation d’au moins sept jours vient s’ajouter à la durée de la garantie qui restait à courir. Cette période court à compter de la demande d’intervention de l’acheteur ou de la mise à disposition pour réparation du bien en cause, si cette mise à disposition est postérieure à la demande d’intervention.

Article 1641 du Code civil

Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l’usage auquel on la destine, ou qui diminuent tellement cet usage, que l’acheteur ne l’aurait pas acquise, ou n’en aurait donné qu’un moindre prix, s’il les avait connus.

Article 1643 du Code civil

Il est tenu des vices cachés, quand même il ne les aurait pas connus, à moins que, dans ce cas, il n’ait stipulé qu’il ne sera obligé à aucune garantie.

Article 1644 du Code civil

Dans le cas des articles 1641 et 1643, l’acheteur a le choix de rendre la chose et de se faire restituer le prix, ou de garder la chose et de se faire rendre une partie du prix.

Article 1648 alinéa 1er du Code civil

L’action résultant des vices rédhibitoires doit être intentée par l’acquéreur dans un délai de deux ans à compter de la découverte du vice.
